High
court on Wednesday issued notices to four police officers, seeking reply on the
arrest of an RTI activist of Jodhpur from his house in February last year.
Justice
Mahendra Maheshwari issued these notices while allowing a petition by activist
Nandlal Vyas seeking action against some police officers stating that the
action against him by these officials was unconstitutional and illegal.
Peitioner’s
counsel Karmendra Singh said that the officer, who barged into his house,
misbehaved with his family members and arrested him, was not the investigation
officer in a case against him under SC/ST Act.
Hearing
the arguments, justice Maheshwari issued notices to the then DCP (East)
Amandeep Singh Kapoor, the then ADCP (East) Anant Kumar, the then ACP Motaram and
the then SHO of Mandore police station Pradeep Sharma.
According
to the petitioner, the police action took place in spite of the fact that the
case had been handed over to the CID (CB) for further investigation. It may be
noted that Vyas, an RTI activist, had been constantly seeking information from
the Agriculture University, Jodhpur, exposing a series of irregularities in the
university regarding misuse of funds and recruitment of staff.
During
one such attempt to extract information from the university, Vyas and
colleagues from his organization ‘Jagriti’, were allegedly attacked by the
university staff and a case against them was filed by him in Mandore police
station.
In
a counter move, a section officer of the university, Khimanath, claiming to be
from ST category, had filed a complaint against Vyas under the SC/ST Act. But
in the inquiry, Khimanath was found to be from OBC category and not the SC/ST
category.
Vyas
had also raised a question on the eligibility of the then vice-chancellor of
Agriculture University, Balraj Singh.
