The Defence Ministry
has denied information on the appointment of Army and Air Force Chiefs, saying
that they are part of classified documents, which are covered under the
Official Secrets Act 1923. Activist Dr Nutan Thakur had sought under RTI
documents related with appointment of the three Heads, to which U K Tiwari,
Under Secretary, Vayu Bhawan and Revati Raman, Under Secretary, Sena Bhawan
said that these appointments are classified documents.
They said
section 8(2) of RTI Act gives discretion to allow access to these documents if
public interest outweighs harm to the protected document but in the given
cases, protected interests outweigh the public interest and hence the
information cannot be provided. Reply about Navy Chief has not come so far.

Kindly provide me the copy of all the Files, including the Notesheet and the
various letters and documents exchanged between the Ministry of Defence and
different offices, as regards the appointments of Heads of the Army (Generals),
Heads of the Air Force (Air Chief Marshals) and Heads of the Navy (Admirals)
from 01/01/2010 till the date on which the information is actually provided.
