The issuance
of a fake caste certificate to Kempaiah, adviser to home minister G
Parameshwara, was raked up once again with Mysuru Congress ST wing leader SH
Subhash on Friday demanding the government sack Kempaiah and initiate legal
action against him.
This comes
after Kempaiah was summoned for questioning by the income-tax department early
this week. Subhash threatened to launch an indefinite protest if the government
doesn't act against the former IPS officer. He circulated copies of the
findings of committees that probed into the allegations.
It's not the
first time the issue is being raised with regard to alleged cheating by him
over the past 27 years. First, the government of India, following a complaint,
had sought a state government's inquiry report in 1990. Despite the Civil
Rights Enforcement Cell (CREC), Bengaluru authorities indicting Kempaiah for
submitting a false caste certificate just to get into Civil Service (IPS) under
the quota reserved for Scheduled Tribes, no action was initiated against him.
The CRCE
was then headed by C Dinakar, IGP.
The issue was
taken up again in March 2009 following an RTI query. The findings of the
Dinakar committee report were submitted along with the query. ADGP of
Directorate of Civil Rights Enforcement, Bengaluru, stated that the inquiry by
Dinakar was true and material facts had not changed since 1990 after a probe.
The officer submitted the finding report to principal secretary, social welfare
department. Again, the government didn't take any action against the officer
though he was found guilty by the probe y committees, Subhash said.
The Dinakar
committee mentioned in its report that the real caste of Kempaiah is
Kuruba/Halumath (backward caste); the claim of Kempaiah that he belongs to Kadu
Kuruba case is not valid and caste certificate of Kemapaiah is invalid.
Kempaiah produced a false caste certificate and got selected to Indian Police
Service in quota reserved for ST in its report. The committee has also
mentioned that Kempaiah had committed offences punishable under sections of
196, 198 and 420 of IPC.
Kempaiah
applied for retirement under voluntary retirement scheme in 2009, two years
prior to his retirement on superannuation. Subhash claimed he had urged the
government not to accept his resignation till a case pending against Kempaiah
in Lokayukta is resolved and action taken against him.
Under
provisions of SC/ST (Prevention of Atrocities) Act 1989, the government can ask
him to pay back the facilities he enjoyed in service for obtaining job through
fake cerficate and thus deprived a genuine ST candidate of opportunity to get
appointed to IPS.
