The state
information commission denied to an applicant details sought about blood
reports submitted to Mumbai Districts Aids Control Society (MDACS).
The reason
given was that the information which is private in nature could not establish
any public interest.
An order for
the same was passed on July 28 by the state chief information commissioner
Ratnakar Gaikwad on an application made by Dadar-based applicant Sanjay Bhide.
In his
application, Bhide had sought information from KEM Hospital pertaining to a
monthly report sent to MDACS and other information. The public information
officer (PIO), said the applicant had not provided proper information. In the
first appeal stage, the first appellate authority (FAA) stated that the
information cannot be given as it was of private nature.
During the
second appeal, upholding the contention of the PIO, and the FAA, the
commissioner stated that though information sought was of private nature, the
applicant could not prove the public interest they would serve and hence
reports were denied.
