A petition
challenging 92 recruitments of assistant advocates general, deputy advocates
general and additional advocates general was heard by Justice Rajesh Bindal in
the Punjab and Haryana high court on Tuesday.
Last week a
lawyer, Pardeep Kumar Raparia, had challenged the selection of 92 law officers
that took place last year in the office of the advocate general of the Haryana
government, alleging that several of them had never appeared in the high court
and were hired only because they were known to politicians, bureaucrats and
judges.
The law
officers hired in the office of advocate general represent the state government
in the high court. The case was filed against the state government and all 92
recruits.
The state of
Haryana had hired 10 officers on November 14; 42 on December 5; and another 40
on December 16 last year.
"I had
filed an RTI on December 29 asking for copies of application forms of law
officers selected by the state and I got a reply saying that no application was
received from the selected candidates. The posts of assistant advocate general,
deputy advocate general and additional advocate general are filled without any
selection process. There are no set criteria to determine their selection. This
leads to the scope for nepotism," said the petitioner, Raparia.
The
petitioner had listed several Supreme Court judgments to support his claim but
the judge has given him a week's time to check if there are previous high court
orders on the issue.
The next date
of hearing has been posted for January 19.
