Do not take any coercive action against Sagar school: HC

The MP high court issued notices to respondents while asking that no coercive action be taken against a petitioner school, which was served a notice of derecognition for violation of RTI rules on admission.
The petition filed by Maulana Azad Middle School in Sagar said that a notice has been served on the school for violation of admission rules under the RTI Act 2011. The notice sought an explanation within 15 days, failing which the school will be unilaterally closed, said the notice.
The petition said that a notice should have been issued to the school management and, on finding the response to the notice unsatisfactory, an inspection of the school should have been carried out. On the basis of the report received from the committee, a decision to derecognise the school could have been taken. Without following the due procedure, a notice to derecognise the school was served on the school, which is illegal.
Principal secretaries of school education, women & child development and tribal welfare department, district collector, Sagar, and other officials of the school education department have been made a party in the petition. Following the initial hearing, the bench of Justice Vishal Dhagat issued notices to the respondents while restraining them from taking any coercive action against the school.
