RTI activist files plea in HC alleging illegal recruitment in Sancoale P’yat

activist Narayan Datta Naik has filed a writ petition in the High Court of Bombay at Goa alleging that there was illegal recruitment of staff and arbitrary pay scales given to the staff in the Sancoale Village Panchayat.
In the petition, Naik, a resident from Sancoale, has claimed that the recruitment was made without following due process of law and contrary to the Rules and Regulations under the Goa Panchayat Raj Act 1994.
“The said appointment of staff is arbitrary and illegal in as much as no approval of the State government and/or the Director of Panchayat is being sought prior to such appointments and such appointments and pay scales are decided as per the whims and fancies of the Director of Panchayats, Block Development Officer (BDO), Sancoale Village Panchayat sarpanch, deputy sarpanch, panchayat secretary, the gram sevak or secretary of village panchayat of Sancoale, panchayat secretary of Arpora, panchayat secretary of Quelossim village panchayat,” he has submitted.
Naik has prayed that the appointment letters issued to seven staffers be quashed and set aside for various posts in the panchayat; to set aside the approval dated November 30, 2016, issued by the Directorate of Panchayats; to direct the panchayat secretary to convene a meeting of the Departmental Selection Committee (DSC) to consider fresh candidates for the various posts and to decide the appointment after recommendation of the DSC.
“The appointments are made without there being any recommendation from the Departmental Selection Committee. In fact, after recruiting the staff in an illegal and arbitrary manner, the Panchayat seeks an ex-post facto approval from the Director of Panchayats and the same is being granted by the Director of Panchayats,” he has submitted.
The activist has contended that the said approval is ex-facie bad in law in as much as the provisions of Goa Panchayat Raj 1994 and Rules therein does not contemplate such kind of ex-post facto approval.
He has submitted further that an amount of public funds has been paid to the staff illegally appointed over the years thereby causing serious loss to the public exchequer.
