Jammu and Kashmir (J&K) have long been a region marred by conflicts and disputes. In recent years, activists and individuals fighting for transparency and accountability in the region have faced significant challenges due to the lack of online Right to Information (RTI) facilities and inadequate training of Public Information Officers (PIOs) and appellate authorities after abrogation of Article 370 and introduced new central laws.
The Right to Information Act, 2005, enables citizens to access government records and seek information regarding various public issues. However, the absence of a comprehensive online RTI portal in Jammu and Kashmir has posed obstacles for activists, making it difficult for them to file RTI applications and track their progress. Unlike many other states in India, J&K has not implemented a user-friendly online system, causing a significant setback for those seeking information.
The absence of an online RTI facility has resulted in several challenges. Firstly, activists face difficulties in submitting RTI applications, as the traditional offline process can be time-consuming and cumbersome. This has discouraged many individuals from exercising their right to information, limiting transparency and accountability in the region. Secondly, the lack of an online portal makes it arduous for activists to monitor the progress of their applications. Tracking the status of an RTI application becomes a laborious task, involving repeated visits to government offices and follow-ups with PIOs. This process not only consumes valuable time but also increases the chances of delays and bureaucratic hurdles. Furthermore, the inadequate training of PIOs in Jammu and Kashmir adds to the challenges faced by activists. PIOs play a crucial role in facilitating the flow of information and ensuring compliance with the RTI Act. However, many PIOs in the region are unaware of their responsibilities or lack the necessary knowledge and skills to handle RTI applications effectively. This results in delayed responses, arbitrary rejections, and even non-compliance with the law.
The empowerment of activists and citizens through the provision of online RTI facilities and well-trained PIOs will serve to fortify democratic processes and uphold the fundamental principles of transparency and accountability in the region. In addition, it is imperative for all departments in Jammu and Kashmir to commit themselves to proactively disclosing information as mandated by Section 4 of the RTI Act 2005.
The lack of proper training for PIOs also contributes to the overall atmosphere of secrecy and opaqueness. Activists often find themselves in a frustrating cycle, where their RTI applications are met with silence or inadequate responses, leading to a sense of disillusionment and discouragement.
To address these challenges, it is essential for the government of Jammu and Kashmir to prioritize the establishment of an efficient and user-friendly online RTI portal. Such a platform would streamline the process, making it easier for activists and citizens to submit applications and track their progress in a transparent manner. Simultaneously, investing in comprehensive training programs for PIOs is crucial. Providing them with the necessary knowledge and skills will empower them to handle RTI applications efficiently, ensuring timely responses and compliance with the law. Regular refresher courses can also be conducted to keep the PIOs updated with any changes or amendments to the RTI Act.
Conclusion: Jammu and Kashmir has the potential to cultivate a transparent and accountable governance system by addressing these pressing issues. This can be achieved by actively engaging with the relevant authorities, and it falls under the responsibility of the General Administration Department (GAD) to ensure and uphold the integrity of the Right to Information Act within Jammu and Kashmir. The empowerment of activists and citizens through the provision of online RTI facilities and well-trained PIOs will serve to fortify democratic processes and uphold the fundamental principles of transparency and accountability in the region. In addition, it is imperative for all departments in Jammu and Kashmir to commit themselves to proactively disclosing information as mandated by Section 4 of the RTI Act 2005.
