The high court has ordered to provide information on the investigation report regarding the violation of human rights in the Popular Front of india protest in Ramanathapuram.
Alauddin of Ramanathapuram filed a petition in the high court branch: 'On 17.2.2014 in Ramanathapuram on behalf of the Popular Front of india organized a demonstration. The police were involved in human rights violations. A petition was filed in the high court branch seeking an order for a judicial inquiry into the matter and compensation to the victims.
The high court after investigating this ordered the CBCID IG to investigate. The IG conducted an investigation and submitted a report. I sent a petition on 20.7.2017 seeking some information under the Right to Information Act regarding that report. The Public Information Officer of CBCID refused to provide information to the petition as CBCID is exempted from providing information under the Right to Information Act. This was also confirmed by the Appellate Officer. I appealed to the State Information Commissioner. He rejected my petition and ordered on 10.5.2023. This order should be canceled and the information requested by me ordered to be provided.' This was stated in the petition.
Judge GR swaminathan passed the order after hearing this petition: "The petitioner has filed a petition seeking some information under the Right to Information Act regarding the violation of human rights. CBCIT is exempted from providing information under the Right to Information Act, so the petition cannot be directed to provide information directly. Is the information asked about corruption? Or to see whether there is a violation of human rights.
If the information about corruption is sought, the Public Information Officer can issue appropriate order on merit. If it is related to human rights, you can provide information that has been approved by the Human Rights Commission. This procedure should be completed in 45 days. This procedure was not followed in the petitioner's case. Appellate Officer cannot interfere at all. Thus, the order passed by refusing to provide the information sought by the petitioner is quashed.
Now Popular Front of india organization is banned. This way you don't have to provide sensitive information that can't be disclosed. Other information may be provided apart from key information. Based on that, the public information officer should provide the information requested by the petitioner by august 2,'' the judge said in the order
