KK Jindal
(77), presently residing in Ganesha Nagar, Bathinda, has been running from
pillar to post to get the Police Department to take action on an order passed
by the Mansa Deputy Commissioner in his case.
Jindal said
after getting his house registered in their name, his sons ousted him from the
house located in Nangal Colony in Mansa in 2015.
Jindal then
approached the Mansa district administration and after meeting several
officials, the then Deputy Commissioner finally marked his application to the
SDM on December 2016, directing the latter to look into the case and get him
the relief as per the Parents Act, if applicable.
“SDM Kala Ram
Kansal, after looking into the case and checking all documents, passed the
order that under Section 23 of the Maintenance and Welfare of Parents and
Senior Citizen Act 2007, the house should be vacated by my sons and be given
back to me. The SDM also ordered cancellation of the registry done in the names
of my sons. However, he also quoted Section 24 and stated that no action was
required to be taken against my sons as I was withdrawing pension and was not
dependent on them,” Jindal explained.
“As per
Section 9 of the Act, the children are not responsible for helping their
parents in case the latter have an income of at least Rs 10,000 per month. But
the children can be made to pay up a fine of Rs 5,000 or three months behind
bars or both in case they misbehave with their parents,” he added.
Jindal added
that apart from the erroneous citing of the Act to save his four sons from any
kind of sentence or fine, action was not taken on the order directing them to
vacate the house.
“The SDM had
passed the orders in May 2017 and no action was taken till October 2017. On
October 4, Mansa Deputy Commissioner Dharampal Gupta stayed the cancellation of
the registry. As per the Act, the children cannot even appeal against the
punishment given to them then how did they appeal against the SDM’s order?”
Jindal asked.
Since the
October order, Jindal wrote to Minister for Social Security Razia Sultana on
December 7 and 18.
“Earlier, on
November 25, I had filed an RTI query with the office of Mansa Deputy
Commissioner requesting the office to share information on the Sections of the
Act on the basis of which the cancellation of registry was stayed,” he added.
Jindal said
he was fighting not only to get his property back but also to make other
elderly citizens aware of their rights and the duties of their children as per
the Act.
