The Chief
Information Commissioner (CIC), Punjab, has served a notice to the IG (Crime)
and DIG (Crime) for failing to supply the information sought by applicant
Sanjay Sehgal, who is a senior vice-president of the RTI Cell of the Punjab
Congress.
A notice to the DIG has been served in the
capacity of the Public Information Officer (PIO), while the IG gets the notice
in the capacity of the appellant authority.
Sehgal said he had filed an RTI application at
the DGP office, seeking information about the guidelines available with the
police pertaining to the Section 498-A of the IPC, adding that he had also
sought details of FIRs registered in all police districts and police
commissionerates of Punjab. Sehgal said he had also sought data pertaining to
the FIRs registered under Section 498-A of the IPC which were later found to be
fake.
He had also sought a copy of the guidelines of
the Ministry of Home Affairs and the Supreme Court of India regarding the
misuse of Section 498-A of the IPC.
Sehgal said the AIG-cum-AIPO, instead of
replying to the RTI plea, had mentioned in the reply, “The PIO is not a post
office or a coordinator for forwarding requests from information seekers to
various departments.” Sehgal said under Section 6(3) of the RTI Act, if the
information seeker is not aware about the public authority, it is the duty of
the PIO to send the application to the authority concerned.
