The Delhi
High Court Friday agreed to hear a plea filed by teachers of Sri Guru Tegh
Bahadur Khalsa College, calling for a stay on the National Commission for Minority
Educational Institution’s (NCMEI) order granting minority status to the
college.
The NCMEI, in
2011, had declared Khalsa College a “minority educational institution”. DU and
some teachers of the college had challenged the order before the high court and
obtained a stay in 2012.
In July 2015,
however, DU withdrew its plea and said it did not have any objection to the
order. The plea filed by the teachers is now being heard separately.
Last July,
the Delhi Sikh Gurdwara Management Committee (DSGMC) had assured the court that
the admission and appointments of teachers would “continue in the old system”
which allows for general admissions and quotas for SC/ST/OBCs. The teachers,
however, alleged that the “minority tag” will adversely affect SC/ST/OBC
students.
On April 18
this year, the lawyer representing DSGMC said that since DU and the government
had accepted the minority status, it would not continue the “interim arrangement”
and will not be bound by the provisions of the SC/ST Reservation Act.
The teachers
again filed a plea seeking a stay on the order. The bench of Justice Sunil Gaur
allowed the college management to “start counselling but not admissions” till
the next hearing Monday.
