Details state
that there has been an increase in the pending number of cases since April 2015
to March 2016.
There are
over 3.73 lakh pending cases in the Metropolitan courts a figure provided
under the Right to Information (RTI) Act.
As per the
details, the pending number of cases in March 2016 has increased from the
opening stock of pending cases in April 2015. While in April 2015, the pending
cases were 3.34 lakh, at the end of March 2016 it stood at 3.73 lakh. The
oldest case dates back to the year 1975.
Cases that
are more than 10-year-old are over nine per cent 33,971. The figures were
provided to RTI applicant Chetan Kothari, who in his application had sought
details of pending cases that are more than five, 10 and 20-year-old.
Information regarding the number of judges presiding in courts in Mumbai and
vacancies, and break up as per each court was also asked.
As per the
details, most number of cases pending were of those that have been in the queue
for up to one year, which is also the only period in which there is a jump. The
figure of such cases increased from 1,02,851 to 1,55,831.
However, the
number of cases that have been in the queue for more than two years and up to
10 years has been no less. It continued to be high at 1,28,533 in March, though
it reduced from April's opening figure of 1,37,497.
Disposals
which has seen ups and downs was up from 2011 onwards saw a jump from 2,42,543
in 2014 to 4,53,759 in 2015. The total number of judges presiding in the courts
stood at 73 while two courts remained vacant.
"It
(number of pending cases) has jumped in a big way. Hearings should happen soon
else people end up spending a lot of money by paying to the lawyer. Also, there
are cases when when a father files a case and son ends up going for the
hearing. Such delay is not justified," said Kothari.
