The NDA
government has decided to go ahead with appointments to statutory bodies like
the Central Vigilance Commission, Lokpal, Central Information Commission and
National Human Rights Commission.
Sources said
the government will have no problem in the appointment of the Chief Information
Commissioner as the RTI act provides a way out in case the LoP is not
recognised. The Chief Information Commissioner is appointed by the President on
the recommendation of a committee headed by the Prime Minister with the Leader
of Opposition and a Cabinet minister nominated by the PM as members. The RTI
Act 2005 clearly says that the leader of the single largest party in the
opposition will be deemed as LoP.
“For the purpose of removal of doubts, it is
hereby declared that where the leader of Opposition in the House of the People
has not been recognised as such, the leader of the single largest group in
opposition of the government in the House shall be deemed to be the Leader of
Opposition,” says the RTI Act, 2005.
Similarly,
the Lokpal and Lokayuktas Act, 2013, suggests that “No appointment of a
chairperson or a member shall be invalid merely by reason of any vacancy in the
selection committee.”
