Almost 10
days after Shaikh Abdul Nayeem alias Nayyu, the alleged Lashkar-e-Taiba (LeT)
militant involved in the Mecca Masjid blast and Mumbai serial train blasts
escaped from police custody, his family on Thursday accused the government
agencies of falsely framing Nayeem in various cases.
They have
produced an RTI application showing contradiction in the claims and allegations
made by the Andhra Pradesh (AP) government and the intelligence agencies.
Nayeem, who
is a native of Aurangabad, was in the custody of Bengal Armed Force. On August
25, he was being taken to Mumbai court from Damdam jail in Howrah-Mumbai
Express in connection with the serial train blasts. He reportedly escaped from
the running train near Raigarh railway station in Chhattisgarh. Nayyem has also
been booked for his alleged involvement in the Ellora Arms Haul and other
serious cases.
The family
members have expressed fears that Nayeem has been either killed or was in
illegal detention of the agencies. They said he was all set to be discharged in
the next few months as the Bombay high court had ordered completion of his
case.
The high
court's directives came after the family of the accused had move the court
contesting that Nayeem has been languishing behind the bars since the last
eight years and the investigation agencies have failed to produce any piece of
evidence against him.
Shaikh Abdul
Faheem, brother of the accused and a lawyer, alleged that Nayeem was falsely
framed in terror cases. He said, "Nayeem was picked from the house in the
city in the name of interrogation on April 1, 2007. Later, it was shown that he
was arrested by the Border Security Forces while trying to sneak into India
from Bangladesh border."
After going
through a 25-day custody, he was handed over to Maharashtra ATS for further
interrogation in connection with the Ellora Arms Haul case.
Raising
questions over the investigating agencies, Abdul Faheem said, "When my
brother was already in police custody almost two months before the Mecca Masjid
blast, then how can he commit the crime?"
Producing a
copy of the RTI reply by the Andhra Pradesh government in February 2011,
Nayeem's mother Qamar Nasreen said the government named Devendra Gupta, Lokesh
Sharma and Swami Aseemanand as the accused in the blast case. My son and many
other innocent people were being kept behind bars for committing the terror
act, she said.
She said the
family will now move the Bombay HC with habeas corpus application demanding a
judicial probe into the matter.
Rejecting the
West Bengal police's version, wherein they said that Nayeem escaped from police
custody, Nasreen said, "My son was suffering from kidney ailment and at
the time of being escorted to Mumbai, five policemen were with him. It is not
possible for a person with such a problem to give a slip to five physically fit
cops. Given all the circumstances, there is a strong possibility that he may
have been killed in encounter or detained illegally."
