The high
court of Bombay at Goa has issued a notice to the state government on a
petition filed by social activist Aires Rodrigues, challenging the appointment
of Kurupati Row as chairman of Goa public service commission (GPSC).
The
petitioner has stated that Row does not possess the qualifications required for
appointment to the post of Goa Public Service Commission' chairman. 'The
minimum requirement that the incumbent chairman /member has to have,
considering the present scenario, experience of ten years under the government
of India or the state government, in view of Article 316 (1) Proviso of the
Constitution of India. This, the respondent No. 2 does not possess,' the
petitioner has alleged.
Rodrigues has
further pointed out that the 'biodata submitted by the respondent No.2 (Row)
itself shows that he has experience only in the management of a government
company, Air India, and does not have any experience under the state government
or the government of India at all'.
Rodrigues has
pointed out that the appointment of respondent No. 2 has been made arbitrarily
and without any system for selection. Referring to the file notings obtained
under the RTI Act, the petitioner has stated that it clearly shows there was no
search committee, no criterion, no system, no call for applications or
nominations and is therefore an arbitrary 'pick and choose'.
The
petitioner has submitted that Row is a relative of chief minister Manohar
Parrikar and he has been appointed as chairman of the commission solely on
Parrikar's recommendation. The petitioner has also alleged that the appointment
is grossly malafide and a fraud on the Constitution.
The state
government has not collected information and material on whether respondent
No.2 had the experience, ability and character for being appointed as GPSC's
chairman, nor considered any other persons who would also qualify for such
appointment, the petitioner has stated.
