The ethics
and scientific review committee of Mahatma Gandhi Memorial Medical College
(MGMMC) has stumped two RTI applicants seeking succession certificates for
replying to their RTI query.
On May 14,
Madhusudan Yadav and Dinesh Chandra Yadav, both sons of Khedulal Yadav and
Keshar Bai had filed an RTI at the MGMMC to seek details of treatment sheet,
serious adverse event form, clinical trial insurance liability form and IPD-OPD
slips of their mother Keshar Bai, who was among the 81 patients who developed
serious adverse event or died after undergoing treatment.
Yadavs had
sought the above said details so as so make a case against the doctors. "I
don't know why is succession certificate required to get information. The
certificate is required in land dispute cases. I have already put up a
complaint with the police. MP medical council is probing the case since long. I
am a successor, which is why complaints were lodged and probe was
ordered," said Madhusudan Yadav, who is also a head constable with
Annapurna police station.
Yadav learnt
that his mother was the victim of clinical trial when additional inspector
general of police (AIG), EOW, Priyanka Mishra, visited his home for probe.
Yadav had then lodged police complaint and to Medical Council of India (MCI).
MCI had then directed Madhya Pradesh Medical Council (MPMC) to act but the probe
is still pending.
Instead of
giving the information, the secretary of ethics and scientific review
committee, Dr Ashish Patel, on the contrary has replied that the information
may be revealed if the applicants prove that they are legal heirs of Keshar
Bai. On the contrary, the committee has asked the name of clinical trial,
researcher's name to find the records. The committee has also asked to submit
patient's admission date, death date and its certificate.

Bhargava, a senior advocate practicing with MP high court told TOI, said,
"Succession certificate is not at all required. RTI act clearly specifies
that you can seek information from any public officer without even disclosing
identity."
