TIMES NOW's RTI query revelations

After 7 weeks of detailed research, TIMES NOW has the documents that show -- the Govt has not started any investigations on Gadkari's company. We were the first to file an RTI query on the 7th of August, we're the first with the detailed revelations.

The RTI filed on August 7 posed the following questions,

1)      Did the ministry of corporate affairs conduct any investigations, enquiry or probe or ask the appropriate investigative agencies to conduct any probe into the shareholding pattern or any other matter related to the Purti Power and Sugar Ltd. (Erstwhile Purti Sahakar Karkhana) during the period between 2007-2012?

2)      If yes, kindly provide the complete and detailed information together with related correspondences, documents, file notings and complete details regarding the status, finding on the above mentioned investigations related to M/s Purti Power and Sugar Ltd. (Erswhile Purti Sahakar Karkhana) as mentioned in query 1.

3)      Did the Ministry of Corporate Affairs or any of its departments raise any doubts, concerns or findings regarding the dubious credentials of investors or dubious locations of the investors in M/s Power and Sugar Ltd?

4)      If yes, kindly provide the complete and detailed information together with related correspondences, documents, file notings regarding the concerns or findings as mentioned in query No 3, including he copy of the letters, complaint letters received by the Ministry of Corporate Affairs or any of its departments from private individuals, complainants who have raised any concerns on the said company or concerns related to matters as mentioned in query number 3.

5)      Did the Ministry of Corporate Affairs receive an RTI/ RTIs on matters related to M/s Purti Power & Sugar Ltd. (Erswhile Purti Sahakar Karkhana) ?

6)      If yes, kindly provide the complete and detailed information together with related correspondences, documents, file notings on the status of the RTI/ RTIs or replies sent as response to the RTI/ RTIs and the complete detailed action with regards to the movement of the file on the said RTI/ RTIs as mentioned in query number 5.

7)      Kindly provide the complete and detailed information together with all related documents regarding the details of ownership, date of ownership and the number of shares of Manohar Madhavrao Panse in the said companies- Spatial Dealers Pvt Ltd, Swiftsol (India) Pvt Ltd, Sterlight Fincom Pvt Ltd, Regency Equifin Pvt Ltd, Leverage Fintrade Pvt Ltd, All wise Finwest PVt Ltd, Mahawideh Securities and Investment Pvt Ltd, Chariot Investrade Pvt Ltd, Rigma Fintrade Pvt Ltd, Ideal Road Builders Pvt Ltd, (IRB Group Co), Earnwell Trades Pvt Ltd, Jainam Mercantile Pvt Ltd, Nivita Trades Pvt Ltd, Seven Eleven Trades and Marketing Pvt Ltd, Update Mercantile Pvt Ltd, Neelay Mercantile Pvt Ltd, Jasika Mercantile Pvt Ltd, Ashwami Sales and Marketing Pvt Ltd, Lastmile Infraprojects Pvt Ltd, Dattatreya Pandurang Mhaiskar (IRB promoter)

8)      How are the companies mentioned in query number 7 related/ linked to M/s Purti Power & Sugar Ltd. (Erswhile Purti Sahakar Karkhana)? Please give complete and detailed information together with all related documents that will establish the details and link between M/s Purti Power & Sugar Ltd. (Erswhile Purti Sahakar Karkhana) to the companies mentioned in query number 7.

9)      Kindly provide any other related information to the above queries mentioned in the RTI.

10)   Kindly provide the file notings on the movement of this RTI petition as well.

Response :

The response TIMES NOW received on October 16 to the questions posed in the RTI were as follows,

With reference to the above, I am to inform you as under:-

Query 1 & 3- As regards query Nos 1 and 3, this office has not carried out any investigation, inspection, technical scrutiny and this office has not received in MCA portal of the above said company during the period mentioned in the application.

Query 2 & 4- For query nos 2 & 4, it is stated that the same are not applicable/ not required to be answered in view of reply to query No 1 and 3 above.

Query 5- This office has not maintained track record of the RTI application received in each and every company so requisite information is not available in this office.

Query 6- Not applicable as stated in query 5.

Query 7- The requisite information may be collected from the MCA's website, which can be accessed by you, by taking inspection of the documents filed by the said companies, on payment of the prescribed fee procedure for viewing and obtaining certified copies of the required documents. In terms of Section 610 pf the Companies Act, 1956, is also detailed in the said website. Further please note that the information which is already available in the public domain would not be treated as "information held by or under control of public authority" pursuant to section 29(i) of the Right to Information Act, 2005. Hence the provisions of RTI Act, 2005 would not be applicable for providing copies of such documents.

Query 8- This is not an information, but an advice or opinion which cannot be requisitioned under RTI Act, 2005.

Query Nos 9 & 10- In view of what is stated above, no further information is needed to be provided.
