In a decision which could have far reaching consequences for the Indian bureaucrats, the Central Information Commission (CIC) has held that “senior public servants” working with organisations other than the government in “private capacity”, which have “numerous interactions with government”, necessary implies “a conflict of interest.”
It also stated, that any government official cannot hide behind the claim that they were working in a “private capacity” in Public Private Partnership projects and instead it is assumed that when they take decisions as members of boards in such projects they “act on behalf of the government.
The decision came on complaint of a Mumbai-based applicant Kishan Lal who had sought some information under the RTI Act from Public Health Foundation of India but the latter claimed that it is not covered under the said Act.
The Commission declared that PHFI comes under the ambit of RTI Act and asked them to comply with its provisions within 30 days.
