Senapati Deputy Commissioner has been ordered to pay a fine of Rs 25,000 for delay in providing information to a person seeking the same under the provisions of RTI act 2005 and also directed to provide the information within a week time.
State Chief Information Commissioner, RK Angousana passed ruling in response to a petition filed by one S Ramhaoleng of Irong Tangkhul, Saikul TD Block, Senapati district.
He lodged a complaint with the RTI Commissioner that Senapati DC Nidhi Kesarwani who is the SIPO of the district administration failed to provide the information he has sought under RTI Act 2005 .
The information he sought included list of IAY beneficiaries for the year 2005-06, 2006-07, 2007-08, 2008-09 and 2009-10 with address/name of the village father's/husbands name by showing in the phase-wise/year-wise separately and clearly indicating those in the waiting for 2009-10 if any.
He also demanded a Xerox copy each of phase/year wise authenticated and certified sanctioned and released order copy of the IAY scheme, one Xerox copy each of APR of each and every beneficiary for the above said years.
A Xerox copy of each of every sanctioned and released order of NREGS additional fund and list of villages benefited under additional fund showing the amount clearly along with work programme orders since its inception/implementation upto August 2009, sanctioned and released orders of NREGS materials component/cost since the inception of the scheme upto the date of receipt of the application along with list of village wise payment of material under the scheme.
Having not received any response from the SIPO (Senapati DC) within the stipulated time, S Ramhaoleng lodged a complaint with the appellate authority, Commissioner of Rural Development on November 6, 2009 but that too was not responded.
State Chief Information Commissioner taken up as an appeal case after the matter was reached to the commission and directed the DC for furnishing the information within 10 days from October 16, 2010 with a warning that penalty may be imposed on her by the commission as prescribed in section 20 of the RTI Act.
Even after a lapse of many months since the submission of application (from 2/9/2009 to 15/11/2010), a hearing of the Commission yesterday considered she is liable for a maximum fine and imposed Rs 25,000 within 15 days from the receipt of the order.
The commission also directed to DC to furnish the information sought by applicant within a week time from the date of receipt of the order failing which the penalty for recommendation of disciplinary action as prescribed in section 20(2) of the RTI Act, 2005.
