Madurai, 16th Sept: The Madras High Court Bench here has criticised the Tamil Nadu Dr. Ambedkar Law University for making a physically challenged lawyer to approach the court even to obtain copies of his answer scripts in two subjects of the Master's of Law degree programme.
Dealing with a writ petition filed by the lawyer R. Ramasamy, who argued the case seated on his wheelchair, Justice K. Chandru said that the conduct of the university could not be appreciated. It ought to have given the copies to the petitioner without driving him to approach this court.
He recalled that the High Court in another case between the Law University and the Tamil Nadu State Information Commission early this year had held that information related to marks scored by a candidate was within the public domain and even a third party was entitled to get it under the Right to Information Act.
However, the judge rejected petitioner's plea to order revaluation of the answer scripts under court supervision. He cited a recent Supreme Court judgement wherein it was held that courts should not generally direct revaluation in the absence of any provision under the relevant statute or statutory rules/regulations.
He also pointed out that answer scripts for M.L. examinations were usually subjected to double valuation. The candidates were awarded average of the marks given by two evaluators. A perusal of the petitioner's answer sheets, submitted before the court,showed that he had obtained only 37 and 28 marks in the two subjects.
