HC asks organisers to reveal marks of all the candidates

The MP high court asked the organisers of Angeevir exam to reveal the marks obtained by all the candidates who appeared in the exam with the petitioners in response to a petition filed by some candidates seeking a direction to reveal the marks obtained by their competitors.
They had filed an RTI for the purpose, which was partly allowed and they were told their marks and cut off marks but the marks of other candidates were not disclosed.
Deputy solicitor general appearing for the respondents submitted that marks of other candidates were not informed to petitioners as same is covered under section 8(1)(j) of Right to Information Act, 2005. Marks obtained by other candidates is personal information and therefore it is protected. It is also submitted that in view of same, the petition be dismissed.
After hearing the arguments of both the parties, the court of Justice Vishal Dhagat said that the petitioners have asked for the marks of the competitors. As, all the candidates had participated in a public examination, this information has no relation with personal information of a candidate. Marks obtained by other candidates in examination is public activity and each candidate has a right to know about the marks obtained by other candidates. If the information is disclosed, the same will not invade upon the personal information of any candidate. Marks obtained by a candidate in an exam can't be personal information. With this observation, the court directed the respondents to provide information regarding marks obtained by other candidates as asked by the petitioners within a period of 15 days from the date of communication of court’s order.
