Ex-Mumbai Congress chief Kripashankar Singh lies to Election Commission.

The troubles of former Mumbai Congress chief Kripashankar Singh, who is already in the dock over disproportionate assets, are set to multiply.
Documents obtained under the RTI Act prove Singh gave out false information to the Election Commission to become an MLA. He is alleged to have been lying about his education qualifications in the nomination affidavits since 1999.
Documents from Singh's college in Jaunpur show that he had failed in his higher secondary exams in 1971. But in his affidavit in the 1999 assembly election, he claimed to have passed BSc, while in the 2004 and the 2009 polls, his affidavit said he had cleared his intermediate examinations.
When contacted, an EC official said: "The documents need to be corroborated. If they are genuine and it is indeed true that Singh lied all this while about his education, then strict action will be initiated against him. We have penal provisions to file a case against the MLA concerned."

No sanction by Centre for prosecution under AFSPA: J-K govt.

The Centre has not accorded sanction for prosecution under Armed Forces (Special Powers) Act (AFSPA) in any of the cases referred to it by the Jammu and Kashmir government. "No sanction for prosecution has been intimated by Ministry of Home Affairs and Ministry of Defence to the state government from 1990-2011 under the (Jammu and Kashmir) Armed Forces Special Powers Act," the state Home Department said in response to an RTI application. The Centre's sanction is mandatory for prosecution of members of armed forces posted in Jammu and Kashmir under Section 7 of the AFSPA, which was promulgated in 1991 at the time of eruption of militancy.

BJP MP Dinu Solanki gets clean chit in Jethava murder case.

The BJP MP from Junagadh, Dinu Bogha Solanki, has got a clean chit from the investigating officer (IO) in connection with the murder of RTI activist, Amit Jethava.
On Tuesday, Surendranagar SP, Raghavendra Vats submitted his voluminous investigation report before the Gujarat high court as per court's direction to probe deeper in Solanki's alleged role in the murder.
Jethava had filed a PIL alleging that Solanki was involved in illegal mining activity in the Gir sanctuary. Few days later, he was shot dead in front of the high court campus on July 20, 2010. City crime branch took up the probe and arrested six persons including Solanki's nephew, Shiva Solanki for conspiracy and planning Jethava's murder.
The city crime branch did not move ahead in its investigation after arresting the six. Jethava's father, Bhikhalal moved HC demanding CBI probe alleging that Gujarat police was shielding the BJP MP. Upon HC directions, Vats carried out further probe.
With his probe report, he has filed an affidavit stating that he has found involvement of no other accused person other than those already arrested and charge-sheeted. In his probe report, which also carried 11-page long statement by Solanki, Vats told the court that call details records were obtained and analysed, bank records were scrutinized to find out whether any transaction had taken place to pay the assassins.
Vat's probe report said that it was Shiva himself who had conspired and paid the amount to assassins by asking the money of his share of ancestral land from his brother. Besides, investigation was carried out in Solanki's mining business, but the IO found no shred of evidence implicating the BJP MP in this murder.
A bench of justices D H Waghela and J C Upadhyay has kept hearing on this case on March 16.

CBI arrests interior designer in Shehla case.

Six months after it began probing the murder of RTI activist Shehla Masood in Bhopal, the Central Bureau of Investigation (CBI) on Tuesday said it has solved the case arresting two people, including an interior designer, Zahida Pervez.
CBI sources said Pervez was the key conspirator in the murder, adding that she had hired a Kanpur hitman called Imran Ali to kill Masood. Imran was nabbed in Kanpur. Masood was found dead in her car in upscale Koh-e-fiza area of the city in August 2011.
The CBI says Pervez, who studied at a Bhopal polytechnic, had a grudge against the slain activist. Pervez's husband owns a petrol pump in Bhopal. While unverifiable reports said Zahida suspected Shehla, who was unmarried, was in a relationship with her husband, CBI officials said the motive behind the killing is yet to be established. The accused will be produced in the special court here on Wednesday.
Shehla was shot dead from point blank range in her car in broad day light on August 16 last year.
There was widespread speculation about those involved in the murder. While some pointed to her close contacts with a section in the ruling BJP, other conjectures said she had "antagonised" an industrial lobby by filing RTI applications seeking information on some high-profile deals. The CBI took up the probe and registered a case on September 3 following a state government request. During the investigation, the agency questioned over 400 people.

City residents pour out civic problems.

On scale, it may not have been a grand affair, but in the second weekly public hearing on Tuesday, 39 cases related to civic body-related grievances were heard in the Sadar Manzil, headquarters of the Bhopal Municipal Corporation (BMC) on Tuesday. Most cases were about water problems, building permission, pension, encroachments and cleanliness-related issues. Besides, 20 cases of similar nature were heard in 14 zone offices of the corporation.
The programme got going from last week, more than two years after chief minister Shivraj Singh Chouhan had made it mandatory for all administrative departments to have weekly public hearing in 2009.
Nitin Saxena, Right to Information (RTI) activist, complained to the BMC higher-ups present that the BMC officials do not provide proper information when an RTI is registered in any department.
Commissioner Rajneesh Shrivastav instructed officials to provide him all the necessary information in seven days and warned the officials against any act of irresponsibility.
Mayor Krishna Gaur, Mayor-in-Council members, corporators, BMC commissioner and all the head of the departments were present at the meeting.
The grievances were registered through mobile phones as well. "We were receiving complaints through phone calls as well," the BMC commissioner said. "The process will continue and the problems of the people will be solved, not only just heard," the commissioner assured.
"It was the first time when a public hearing was conducted at a grand level," BJP corporator and MiC member Krishna Mohan Soni told TOI.
"It is a good thing that the new commissioner began the practice of public hearing," BMC council chairperson Kailash Mishra told TOI.
Former commissioner of the BMC did not conduct any public hearing in his tenure despite the state government orders for the same.

The Mumbai police have been tasked with riddling out a philosophical question: how do they define an abstract virtue such as honesty? The problem finds its origins in a circular sent by the home department yesterday that directs the men in khaki to give police protection to RTI activists, provided they are honest.
The circular comes in the light of the death of RTI activist Premkant Jha. He had sought information on the illegal construction in Virar, and was shot dead in broad daylight on Sunday while riding his motorcycle. Police are yet to make arrests in the case.
The problem is, policemen said, that given the past records of
several RTI activists, they doubt they would be able to find many with integrity. "A lot of these activists often misuse their situation, blackmailing builders and businessmen. When they get threatened in turn, they come to us for protection.
The word 'honest' in the circular is important, and I am sure it will be difficult to identify honest RTI activists," said a police officer from Dahisar police station, Said another officer from Dharavi police station, "Many RTI activists are dishonest and crafty. I know one so-called activist who was working for the underworld and even had a murder case against him. Should we protect them too?"
The home department has sent the circular to all city police stations and has also filed an affidavit in the High Court. "Protection will be given to honest RTI activists who work for social welfare. The protection will be provided if they ask for it and after studying the situation and the perceived threat level," said a home department source. He added, "We have also simplified the process of giving protection. If some activists approach the police, they can register an FIR/NC and the police inspector on duty along with his seniors can take a quick decision."
Under attack:
But their cynicism, justified or not, doesn't detract from the fact that there is a surge in violence against activists. Jha's case is only the latest in a long list of attacks on whistleblowers in Maharashtra. Activist Ramdas Ghadegavkar was found dead in Nanded in August 2010. Datta Patil who exposed corrupt bureaucrats was killed in Ichalkaranji in May 2010. Education activist Vasant Gite was murdered in Aurangabad in April 2010. Whistleblower Arun Sawant was killed in Thane in February 2010. Satish Shetty, who took on the builder mafia in Talegaon, was slashed to death in January 2010. Scores of other activists in the state have also been assaulted or threatened.

Despite SC judgment, HSC Board refuses copy of answer sheet under RTI.

A student from Mumbai who appeared for her HSC Board examination in October 2011 has been denied last week, copies of her original answer sheets of the three subjects.
Last week, an anguished mother wrote to me: “This is xxxxx xxxxx from Mumbai. I have applied for a certified copy of my daughter’s answer sheets from Maharashtra HSC Board as per the RTI (Right to Information) Act. I received a letter from HSC Board stating that I can only see the answer sheets and they are not liable to give me a certified copy. Please advise me what I should do further. Please reply me urgently as the date kept for inspection is 24 February 2012.”
Reesha (named changed) had appeared for her Standard XII of the Maharashtra State Board of Secondary & Higher Education in October 2011. Her results showed that she had failed in three subjects. This prompted her mother to invoke the RTI Act to procure certified copies of her answer sheets. Last week, she visited the SSC/HSC Board office (as it is commonly termed) located in Pune but was denied the copies, in flagrant violation of the Supreme Court judgment in August 2011, which gives every student the right to copies of his/her answer sheets.
The manner in which the officials of the HSC Board dealt with this issue is truly shocking. When this mother applied for certified copies of her daughter’s original answer sheets of three subjects on 7th January to the Public Information Officer (PIO) of the HSC Board, there was no reply. The pretext being the Board is still framing guidelines on the information to be given for queries of copies of the answer sheets, as a sequel to the Supreme Court judgment of August 2011. However, a circular issued by the state government on 27th December had clearly stated that the Supreme Court directive should be followed in true spirit until the guidelines have been formulated and formalized.
Since the PIO did not reply, this mother filed an appeal to the First Appellate Authority (FAA). (Just to recall, the Supreme Court has given a historic order ruling that every student of this country has the right to get a copy of his or her answer-sheet in every examination he or she sits for be it the state board, CBSE or any other competitive examination!)
The FAA allowed the mother to only see the answer sheets (as if it was doing a big favour) on 24th February, with just 24 hours’ notice. The mother resides in Thane and she had to come to Pune immediately the next day. However, the letter sent by the FAA harshly put down terms and conditions, making the applicant feel like a “criminal”. They are:
You are allowed to only see the answer sheets. You will not be allowed a copy of the same
     You will be given only 10 minutes to see the answer sheets
     You will be charged Rs500 for seeing the answer sheet of each subject
     You are required to get a demand draft for the same
     If you are not present at the scheduled date for seeing the answer sheet, you will never be given an opportunity again
     Please do not get any writing pad, pen, mobile, mobile camera or any other electronic gadget along with you
     You will have to fill a form stating that you will not indulge in any misconduct while seeing the answer sheet
     If the student tries to misbehave, a police case will be registered against him/her
     Only one guardian/parent will be allowed to accompany the student to see the answer sheet
     The applicant and his guardian/parent will have to state in writing that they have seen the answer sheets
     The student will not be allowed to see the answer sheets again
     Please note that your visit would be under CCTV surveillance
Vijay Kumbhar, a RTI activist, and I suggested to the mother to visit the HSC Board as per the FAA’s orders but to register her protest regarding denying her right to be given certified copies of the answer sheets and against the charges of Rs500 per subject for seeing answer sheets. When she paid the visit, she was shown the answer sheets. She registered her protest verbally.
What should she do? She should immediately write to the Supreme Court complaining about its order being violated, says Mr Kumbhar. He also points out that, “if the FAA has mentioned that information could not be provided because the Board has yet to frame the guidelines, then how could it charge Rs500 per subject from the RTI applicant? Also, if the HSC Board has anyway shown the answer sheet, isn’t it meaningless not to provide her the certified copy? Also, when the Board’s circular has clearly stated that the SC order should be followed until its own guidelines are framed, why did it violate this norm?
Leading RTI activist and legal luminary Divya Jyoti Jaipuriar who appeared on behalf of the petitioner in the answer sheet case had stated after the Supreme Court judgment, “In the order delivered by the Supreme Court, the bench clarified that the evaluated answer sheet is covered under the definition of ‘information’. It also clarified that it is the duty of the Public Authority to allow maximum disclosure as envisaged by the RTI Act.”'
He further stated that, “Dealing with the issue of ‘fiduciary relationship’, the court has explained the fiduciary relationship in detail and held that the examination conducting bodies do not retain the evaluated answer sheets under any fiduciary capacity. Hence, the court held that that the exemption under Section 8 (1) (e) will not apply to the disclosure of answer-sheets. The court also dismissed the contention that the entire system will collapse once disclosure is allowed under the RTI Act. As a matter of fact, it was argued on behalf of the MKSS and JOSH that some universities allow disclosure of answer sheets under the RTI Act and they do not face any difficulty in the process and their system have not ‘collapsed’.”
The HSC Board’s move is indeed detrimental to information dissemination and transparency in educational institutions and boards.

बोर्ड की गलती, खामियाजा भुगतेंगे आरटेट अभ्यर्थी.

राजस्थान माध्यमिक शिक्षा बोर्ड की गलती का खामियाजा आरटेट में बैठे प्रदेश के सैकड़ों अभ्यर्थियों को भुगतना पड़ सकता है। बोर्ड द्वारा ली गई आरटेट परीक्षा में दो प्रश्नों के उत्तर गलत जांचने के कारण अनेक अभ्यर्थियों की प्रतिशत प्रभावित हुई है। इसके चलते राज्य सरकार द्वारा की जाने वाली थर्ड ग्रेड टीचर भर्ती में प्रदेश के सैकड़ों अभ्यर्थी सम्मिलित होने से वंचित हो जाएंगे।
बोर्ड की ओर से जुलाई 2011 में ली गई आरटेट परीक्षा में डी सीरीज के प्रश्नपत्र में प्रश्न संख्या 117 और 124 के उत्तरों की बोर्ड ने गलत जांच की है। अभ्यर्थियों के उत्तर सही होने पर भी बोर्ड ने उन्हें गलत करार दे दिया है। इसके चलते जिन अभ्यर्थियों ने सही विकल्प भरे थे, उसके बाद भी उनके दो अंक कट गए हैं। अजमेर निवासी अभ्यर्थी कपिल परमार भी ऐसे ही अभ्यर्थियों में शामिल है। कपिल ने सूचना के अधिकार के तहत जब बोर्ड से ओएमआर शीट की प्रति और बोर्ड द्वारा जारी की गई उत्तर की का मिलान किया तो इसका खुलासा हुआ। "पहले बता देते, अब परिणाम जारी हो चुका है। अब क्या किया जा सकता है।"
पीसी जैन, विशेषाधिकारी (परीक्षा) सह समन्वयक आरटेट ये हैं प्रश्न जिनके उत्तर बोर्ड ने गलत जांचे
प्रश्न संख्या 117- भारतीय संविधान भाग 4, अनुच्छेद 51 में नागरिकों के कितने मूल कर्तव्य वर्णित हैं?
विकल्प- 10, 12, 15 और 11  बोर्ड ने विकल्पको सही माना, जबकि परमार समेत अनेक अभ्यर्थियों ने विकल्पको सही किया।
इसलिए है सही:
अभ्यर्थियों ने मूल कर्तव्य 11 बताए। बोर्ड की कक्षा 10 की गणित (द्वितीय भाग) के अंतिम पृष्ठ पर भी मूल कर्तव्य 11 ही बताए गए हैं। जबकि आरटेट की ओएमआर शीट की जांच में इसे गलत बताते हुए 10 मूल कर्तव्य को सही बताया है।
प्रश्न संख्या 124 : महात्मा गांधी ने अपनी आत्मकथा किस भाषा में लिखी?
विकल्प : ए- हिंदी, ब- मराठी, स- गुजराती और -अंग्रेजी विकल्प दिए गए।
बोर्ड ने इस प्रश्न का उत्तरअंग्रेजी सही करार दिया। लेकिन वास्तविकता यह है कि महात्मा गांधी ने अपनी आत्मकथा गुजराती में लिखी थी। अभ्यर्थियों ने विकल्पअर्थात गुजराती सही किया लेकिन परीक्षकों ने इसे गलत करार देकर अंक काट दिए। एक अंक मिल जाता तो थर्ड ग्रेड का पात्र हो जाता
परमार के मुताबिक आरटेट में उसे 89 अंक मिले हैं। अगर बोर्ड दो प्रश्न सही करार देता है, तो उसके अंक हो जाते हैं 91 और वो थर्ड ग्रेड भर्ती परीक्षा में बैठने का पात्र हो सकता है। परमार के मुताबिक प्रदेश के ऐसे सैकड़ों अभ्यर्थी हैं, जो एक अंक से ही पिछड़ रहे हैं।
सचिव ने दिया यह जवाब:
अगस्त 2011 में बोर्ड ने आरटेट का परिणाम घोषित कर दिया था। इसके तुरंत बाद ही परमार ने सूचना के अधिकार के तहत बोर्ड में अर्जी दायर कर दी थी। लेकिन बोर्ड ने जवाब देने में काफी विलंब किया। बोर्ड सचिव समन्वयक मिरजूराम शर्मा ने सूचना के अधिकार के तहत परमार को दिए जवाब में लिखा- ‘विषय- प्रश्न पुस्तिका के उत्तर में त्रुटि के बाबत। उपरोक्त विषयांतर्गत लेख है कि प्रश्न पुस्तिका में त्रुटि की सूचना आप द्वारा परीक्षा परिणाम घोषित होने के बहुत समय बाद प्राप्त हुई है। अत: इस पर अब कोई कार्रवाई करना संभव नहीं है।
गणित की किताब के पीछे ये छपे हैं 11 मूल कर्तव्य:
1.      संविधान का पालन करें और उसके आदर्शो, संस्थाओं, राष्ट्र ध्वज और राष्ट्रगान का आदर करें।
2.      स्वतंत्रता के लिए हमारे राष्ट्रीय आंदोलन को प्रेरित करने वाले, उच्च आदर्शो के हृदय में संजोये रखें और उनका पालन करें।
3.      भारत की संप्रभुता, एकता और अखंडता की रक्षा करें और उसे अक्षुण्ण बनाए रखें।
4.      देश की रक्षा करें और आह्वान किए जाने पर राष्ट्र की सेवा करें।
5.      भारत के सभी लोगों में समरसता और सामान भ्रातृत्व की भावना का निर्माण करें, जो धर्म, भाषा और प्रदेश या वर्ग पर आधारित सभी भेदभावों से परे हो, ऐसी प्रथाओं का त्याग करें जो महिलाओं के सम्मान के विरुद्ध हो।
6.      हमारी सामासिक संस्कृति की गौरवशाली परंपरा का महत्व समझें और उसका परीक्षण करें।
7.      प्राकृतिक पर्यावरण की जिसके अंतर्गत वन, झील, नदी और वन्य जीव हैं, रक्षा करें, और उसका संवर्धन करें तथा प्राणी मात्र के प्रति दया भाव रखें.
8.      वैज्ञानिक दृष्टिकोण, मानववाद और ज्ञानार्जन तथा सुधार की भावना का विकास करें।
9.      सार्वजनिक संपत्ति को सुरक्षित रखें और हिंसा से दूर रहें।
10.   व्यक्तिगत और सामूहिक गतिविधियों के सभी क्षेत्रों में उत्कर्ष की ओर बढ़ने का सतत प्रयास करें, जिससे राष्ट्र निरंतर बढ़ते हुए प्रयत्न और उपलब्धि की ऊंचाइयों को छू सके।
11.   6 से 14 वर्ष तक के बच्चों को उनके अभिभावक अथवा संरक्षक या प्रतिपालक जैसी भी स्थिति हो शिक्षा के अवसर प्रदान करें।
    आत्मकथा गुजराती में लिखी : विकीपीडिया दे इन्साइक्लोपीडिया के मुताबिकसत्यना प्रयोगों अथवा आत्मकथा’( स्टोरी ऑफ माईएक्सपीरियंस विद ट्रुथ) मूलत: गुजराती भाषा में लिखी है। इसका अंग्रेजी में अनुवाद महादेव देसाई ने किया।
