In a jolt to
Madhya Pradesh Public Service Commission (MPPSC), Supreme Court has directed
the Commission either to give government job or Rs 5 lakh compensation each to
four candidates who were “wrongly” declared disqualified in an exam.
MPPSC had
conducted exam for Assistant District Prosecution Officer (ADPO) exam in 2010.
In the model answer sheet of the paper which was released by the MPPSC, answers
to four questions were allegedly wrong. On the basis of this model answer
sheet, the MPPSC had got response sheet evaluated and subsequently declared the
results.
Among the
disqualified candidates were Chanchal Modi, Rajveer Yadav, Kuldeep Bhadoriya
and Mayank Bhardwaj.
Claiming that
answers to four questions in the model answer sheet were wrong, the quarter had
filed a complaint with MPPSC claiming that they had answered the question write
but as wrong answer were chosen by the Commission they flunked the exam.
The complaint
fell on deaf ears. To this, all four candidates moved Madhya Pradesh High Court
that directed for constitution of a committee of the subject experts to look
into the matter. In its report to the court, the committee accepted that the
claim of the petitioners were right.
Moved by the
committee’s report, the High Court had directed the MPPSC to offer ADPO job to
the candidates and if there is no vacancy, then the candidates should be given
a compensation of Rs 5 lakh each.
The matter
was kept in the apex body meeting of the MPPSC which suggested moving Supreme
Court. The State government also advised the same to the MPPSC after which a
petition was filed in the apex court challenging the High Court’s order.
After going
through the case, the Supreme Court upheld the decision of the High Court and
directed the MPPSC to give ADPO job to the candidates and if there is no
vacancy, then the candidates should be given a compensation of Rs 5 lakh each.
As per the
SC, the order has to be implemented within seven days from the receipt of the
certified copy of the judgement.
Recently, the
MPPSC had started process for filling vacant post of ADPO which implies that
there is vacancy. The petitioners said
that they would prefer a job to compensation.
“The issue
will be discussed in the MPPSC meeting. Guidance from the state government will
also be taken over the matter. Whatever the case, the SC ruling has to be
complied with.”

“We would
have accepted compensation if there would have no vacant position of ADPO. As
per documents taken by us through RTI application, there are vacant posts of
ADPO. Citing that, we have sought appointments on ADPO post. If our demand was
not met, we will file contempt petition in court.”
