Tiwari denied RTI info on removal of security

Rajasthan State Information Commission (RSIC) has refused to provide information under RTI Act to former BJP leader and MLA from Sanganer Ghanshyam Tiwari regarding removal of his security.
Tiwari’s security was removed by the state government last year after intelligence department report stated that the MLA doesn't require any security cover. He had filed an RTI application to find out from the intelligence department the reasons as to why his security was removed. His application was rejected by the RSIC on the grounds that intelligence department doesn’t come under the ambit of RSIC.
Tiwari was given police security by the Congress government in 2008. Under RTI, Tiwari had asked questions a copy of each intelligence department report and state government order removing his security along with order of the Congress government granting him security.
After the information was denied in the first appellate, he filed an appeal in RSIC. The former BJP leader contended that information is related to his human rights and should be granted. “Since the security cover was removed he was attacked for the five times. The matter is related to his human rights and RTI act allows access to the information related to life,” said applicant in his application.
Ashotosh Sharma, information commissioner, RSIC says that under the Section 24 of RTI act 2005 information falling under intelligence department cannot be released. “The advocates of Tiwari have failed to prove that denying of information has violated his human right. The matter is disposed-off,” said Sharma. Notably, the security cover was removed by the Raje government after intelligence report stated that security is not required for the leader. The cover was removed allegedly due to Tiwari’s difference with Raje. The former has exited from the BJP and floated a new political outfit.
