The High
Court of Karnataka on Wednesday granted a stay on the notification bringing the
Sri Brahmi Durga Parameshwari temple in Kundapur taluk, Udupi district, under
provisions of the Right to Information Act.
The temple
had moved the court challenging the notification contending that the assistant
commissioner, Hindu Religious Institutions and Charitable Endowments does not
have the jurisdiction to include the temple under the Right to Information Act.
The assistant commissioner is only empowered to act according to the procedure
under the Karnataka Hindu Religious Institutions and Charitable Endowments Act,
1997. Justice A S Bopanna granted stay on the notification and ordered notice
to the Karnataka Information Commission.
